Right of withdrawal

Fourteen days to change your mind, how to say so and what comes back.

Anything in square brackets is a detail of the owner still to be filled in. It is left in plain sight on purpose: a gap you can recognise beats a detail that was made up.

You can change your mind

If you buy at a distance as a consumer you have fourteen calendar days to withdraw from the purchase, with no explanation and no penalty. It is a right Spanish consumer law gives you, and nothing written here can cut it back.

When the fourteen days start

On the day the piece reaches you or whoever you named. If an order arrives in several parcels, from the last one. They are calendar days; if the last falls on a Saturday, Sunday or public holiday, you have until the next working day.

How to do it

Just say so clearly before the fourteen days are up:

  • By writing to Detail still to be filled in: [CONTACT EMAIL] with your name and the order reference.
  • Or by post to Detail still to be filled in: [POSTAL ADDRESS OF THE STUDIO].
  • Or by filling in the model form at the end of this page, which is not compulsory but makes it easy.

Any way that leaves a record will do. Keep a copy: the proof of having withdrawn in time is yours. As soon as your notice arrives, you get an email confirming it.

What you get back

Everything you paid, including standard delivery costs. If you chose a delivery option dearer than the standard one, the standard amount is what comes back.

The money returns at most fourteen calendar days after you say you are withdrawing, by the same means you paid with and at no cost to you. It may be held until the work arrives back, or until you show that you have sent it, whichever comes first.

What you have to do

Send the piece back within fourteen calendar days of telling us, well packed and, if possible, in the packaging it arrived in, which is made for exactly that.

The direct cost of returning it is yours. For a large or fragile piece it can be considerable: Detail still to be filled in: [ROUGH COST OF RETURNING A LARGE PIECE]. If you would rather, write before sending it and you will be told the safest and cheapest way.

You can unwrap the work and look at it as you would in a gallery. If it loses value because it has been handled beyond that —scratched frames, folded paper, touched paint— that loss of value may be deducted from your refund.

When there is no right of withdrawal

The law leaves some cases out, and the first one is the one that touches this shop:

  • Work made to order or clearly personalised: a portrait, a piece to your measurements, or any work begun after you ask for it and following what you ask. There is no withdrawal, because it cannot be offered to anyone else. Before you commission anything you are told so in plain words.
  • Digital content without a physical medium whose download starts with your express permission and in the knowledge that you thereby lose the right to withdraw.

Everything else —an original already painted, a print, a plate— can be withdrawn from as normal.

This is not the guarantee

Withdrawing is changing your mind. If the piece arrives damaged or is not what was offered you do not need to withdraw: that is the legal guarantee, it does not end after fourteen days, and it is set out in the sales terms.

You only need to fill this in and send it if you want to withdraw; using it is not compulsory. You can copy it straight into an email.
